Gladstone DWI/DUI Lawyer

Arrested for DWI?

The consequences of a DWI are serious. You can lose your privilege or license to drive. You can go to jail. If you get probation, it comes at a substantial financial cost and inconvenience. You will be evaluated at your cost to determine the nature and extent of any dependency or addiction. Your license will not be fully reinstated until you complete any recommended education or treatment. You may go to jail or even prison. You might be required to have an ignition interlock device installed on any vehicle you operate or to wear an ankle bracelet that will monitor your alcohol consumption and possibly your whereabouts. Your financial obligations will be substantial while you may experience sharply higher insurance premiums. Any finding of guilt, not just a conviction will be on your record for a minimum of 10 years and possibly life. Every time you are stopped or pulled over, an officer can and often will check your alcohol arrest record and will know of your record at roadside.

When an employer or landlord does a background check, he or she can find that alcohol related enforcement contact. Your insurance company will increase your premium if you do not successful challenge a license sanction or experience a criminal conviction for driving while intoxicated, driving under the influence or driving with an excessive blood or breath alcohol concentration.

But many DWI cases can be won. I know from personal experience. That hopeless case may not be hopeless. I am Jeff Eastman, an experienced and determined defense lawyer. My firm represents clients in all types of DWI/DUI cases, including first-time DWI offenders, repeat DWI offenders and DWI accidents cases.

Aggressive DWI Defense

Mistakes are often made in the investigation and chemical testing process. A small oversight or omission can be the difference between prison and probation, a conviction and an acquittal, a DWI and a dismissal.

When I represent a client, I thoroughly review every aspect of the events leading up to the arrest and thereafter. I look for that omission or oversight. I look for trends in the law that maybe beneficial to you. I consider sources outside Missouri for successful arguments and tactics.

Factors that may lead to a more favorable disposition or dismissal of a DWI charge include:

  • Lack of probable cause for the police to stop
  • Lack of probable cause for the police to arrest you
  • Improper administration of field tests
  • Inadmissible breath or blood tests
  • Unique personal characteristics including biological and physiological issues which affect field testing and chemical results
  • Many other factual and legal issues

When it helps my client's case, I consult with experts in a variety of disciplines including field testing, toxicology, pharmacology, physiology, ophthalmology, chemistry, accident reconstruction, statistical analysis, and many others. I have developed these relationships to better assist the client serious about the defense of their case. This is critical when defending you!

You Need a Lawyer for Your First DUI Offense

Even if this is your first offense, you need to aggressively defend against the DWI/DUI accusation. If have been previously found guilty of DWI and are arrested again, you face substantially harsher punishments including the possibility of jail, an extended loss of license, an ignition interlock on any vehicle you operate and monitoring for alcohol consumption, all at your cost.  Your third DWI in a lifetime may now be filed as a felony.

In some instances, ten years after your first finding of guilt to driving while intoxicated or driving with an excessive blood alcohol content, you may be able to have all records of your arrest, plea, trial, finding of guilt and license sanction expunged.
